BIC resolves dispute through asynchronous online mediation
Recently, the Beijing Internet Court (BIC) successfully resolved a dispute through asynchronous online mediation by making full use of the "Communication and Exchange" function of the People's Court Online Service Platform.
The innovative approach enabled the parties to reach a settlement efficiently and facilitated the prompt realization of their lawful rights and interests.
Following the termination of enforcement proceedings in a civil enforcement case, Wang applied to the court to add the capital contributor of the original judgment debtor as an additional person subject to enforcement.
After accepting the case, the court served relevant case materials on both the judgment debtor and the respondent. Upon establishing contact with the respondent, the court actively organized mediation between the parties. Through communication and negotiations, the parties reached a preliminary consensus on key issues — including the amount of compensation, the time limit for performance, and the method of payment.
However, as the Spring Festival approached, both parties had demanding work schedules and were unable to arrange a mutually convenient time to participate in an online mediation session.
To address this practical difficulty, the BIC explored the use of the "Communication and Exchange" function on the online service platform and guided the parties in conducting asynchronous online discussions. Through the platform, the parties verified the details of the proposed settlement and finalized the terms of their agreement.
The court subsequently supervised the respondent's performance of the settlement obligations and required the uploading of proof of payment. The applicant then confirmed receipt of the compensation online.
From the parties' agreement to proceed with asynchronous mediation to the applicant's receipt of full compensation, the entire process took less than three hours, resulting in the prompt and substantive resolution of the dispute.
This case demonstrates the BIC's continued efforts to enhance the functionality of the online service platform and expand the application of asynchronous proceedings in dispute resolution.
By enabling parties to participate in mediation without appearing online simultaneously, the court significantly improved the efficiency of dispute resolution and the protection of litigants' rights and interests. The practice reduced procedural burdens on the parties while making dispute resolution more efficient, convenient, and accessible.
The case provides a vivid example of how digital technologies can help improve judicial services by allowing data to do more of the work while minimizing the burden on litigants.
