Jiang Ying addresses 17th Beijing CNDCA Symposium on Rule of Law in Private Sect

Upon invitation, Jiang Ying, president of the Beijing Internet Court (BIC), attended and delivered a keynote speech at the 17th Beijing CNDCA Symposium on the Rule of Law in the Private Sector on Nov 8. The symposium was hosted by the China National Democratic Construction Association's Beijing Municipal Committee.
Themed "Stability, fairness, transparency and predictability — the implementation and improvement of the Private Sector Promotion Law", the meeting focused on important issues including promoting the high-quality development of the private economy and improving the law-based business environment.

In her speech under the theme "Leveraging courts' functional role to safeguard the high-quality development of the private economy", Jiang introduced the BIC's practices in protecting private enterprises and entrepreneurs' rights and interests, and in building a law-based business environment.
She focused on three aspects, namely fulfilling duties in accordance with the central tasks of the country, enhancing the leading role of adjudicatory rules, and strengthening coordinated mechanisms for judicial protection.
She noted that the BIC has always adhered to establishing rules through judgments, enhancing governance through rules, and advancing development through governance. She highlighted a series of typical cases heard by the BIC, including infringement of the right to reputation of an enterprise's founder, the country's first case on unfair competition involving the efficacy identification of a data intellectual property rights registration certificate, and the country's first case of affirmed compulsory collection of users' images by an APP.

She emphasized that the BIC will take the adjustment of its jurisdiction as a new starting point to implement the Private Sector Promotion Law. The BIC will regulate algorithm discrimination, unfair competition and infringement of personal information. It will also enhance its research on frontline judicial issues related to artificial intelligence, big data and other major topics, so as to build a stable, fair, transparent and predictable law-based business environment, she noted.
