What documents you need to file a case online at BIC

Here is a guide to filing a case at the Beijing Internet Court (BIC), a look at necessary documents for e-litigation at the court. 

  • If you are a natural person plaintiff, you need to register and log onto the BIC's e-litigation platform. Click on "I want to file a case", and submit photos of your ID card (both sides are needed).

  • Legal (non-natural) persons or unincorporated organization plaintiffs need to submit scanned versions or photos of their valid business license (and the organization code certificate stamped with any required official seal if necessary), and the certificates of identification of the legal representative, namely ID card and job title certificate.

  •  If you have a lawyer as the agent ad litem, scanned versions or photos of the lawyer's ID card (both sides are needed) and qualification certificate, power of attorney, and a confirming letter from his or her law firm are required.

  • If your agent ad litem is not a lawyer, scanned versions or photos of his or her ID card (both sides are needed), power of attorney and documents certifying that he or she is a close relative or staff member of yours, or recommendation documents from his or her community, workplace or relevant social organizations are required. If he or she is your or another company's employee, his or her labor contract is required as well. 

Please note that a single litigant may appoint at most two persons as agents ad litem. 

Next, information about the defendant is needed.

  • If the defendant is a natural person, his or her name, age, gender, ID number, permanent address, contact information and other ID related information must be submitted.

  • If the defendant is a legal person or an unincorporated organization, the scanned versions or photos of its valid business license, location of registration, company address and certificates of identification of the legal representative are needed.

Please note that a query of the defendant's files registered with the market regulator must be made on the National Enterprise Credit Information Publicity System website before materials are submitted. It is to provide the enterprise's current situation, as well as its location. 

If you already have an indictment, please directly upload it together with other documents. Otherwise, fill in the facts and reasons of the claim step by step, and the system will automatically generate an indictment. The system supports batch uploads and automatic generation of a bill of materials. 

Note: When uploading evidence materials, you are advised to make a catalogue listing all evidence. A PDF file summarizing all evidentiary documents is recommended if there are a substantial number; it can be used to collect information such as the submitter, case number and submission time in the evidence catalogue. 

If the e-evidence is too big in size to be uploaded to the e-litigation platform, you can upload it to an online drive, and then submit the link and access code of the online drive to the e-litigation platform under the "litigant materials submission" category. Or it could be put in a CD and delivered to the court and the opposite party.
