Four judgment documents from the Beijing Internet Court (BIC) were recognized in the 11th Selection of Excellent Judgment Documents of Beijing Courts with one receiving the first prize and three winning excellence awards.

First prize: A case on infringement of personality rights

The case is China's first case involving infringement of personality right through AI-generated voices. The BIC clarifies, where an AI-generated voice is identifiable, the protection of a natural person's voice interests extends to such AI-generated voices. The identifiability should be determined by comprehensively considering how it is used and whether an ordinary listener in the relevant field can recognize it.

Excellence award: A case on online tort liability involving AI face-swapping technology

The case is Beijing's first online tort liability case involving AI face-swapping technology. The judgment highlights that while AI technologies have created new business models and user experiences, platform operators and the public should remain mindful of the boundaries of legal liability. The case provides guidance for the application of AI deep synthesis technology in the cultural market. By accurately identifying rights holders and the nature of the rights involved, and reasonably defining tort liability, it helps regulate authorization practices and promotes the healthy development of the data factor market and emerging cultural markets.

Excellence award: A case on online tort liability dispute involving cyberbullying

This case is a typical example involving cyberviolence and school bullying. The case clarifies that online service providers are required not only to fulfill their post-incident obligation under the notice-and-takedown mechanism, but also to take preventive measures against infringement and promptly address infringing conduct when they know or should have known of its occurrence. The judgment further emphasizes platform's primary responsibility for the information content management, the need to establish clear rules of conduct, their heightened duty of care in protecting minors online by taking timely measures to prevent and stop cyberbullying and cyberviolence, thereby better shield safeguarding minors' lawful rights and interests.

Excellence award: An case on an online service contract involving AI-generated content

In this case, the court held that the platform operators have the right to examine whether content published by internet users is are AI-generated and to take corresponding measures.bear the burden of proving the reasonableness of algorithmic decisions and providing appropriate explanations. The judgment affirms the positive role of platform operators in online information governance, helps prevent algorithm misjudgments, and better protect users' legitimate rights and interests.
